Key Legal Requirements for Getting Married
According to it.usembassy.gov, these are the requirements to get married as a non-resident:
- Both adults need to be at least 18 years old
- Atto Notorio, which is the legal declaration (before notary public) of single status and eligibility to marry without obstacles
- Affidavit or “Dichiarazione Giurata” which is similar to Atto Notorio. Schedule an appointment for notary services with US Consulates General in Italy or the US Embassy in Rome to swear before notary the ability to marry as a resident of the United States without impeding legal restrictions.
- Declaration of Intention to Marry, which should be presented to the town hall (municipio) Marriage Office (Ufficio Matrimono) of the city that will hold the wedding ceremony
- 2 Witnesses that are not family and over 18 years old
- Original US passports or US Military ID cards
- Copies of foreign birth certificates with legal translation into Italian
- If divorced, copies of divorce certificates with legal translation into Italian
